Maximus Pulse Privacy Policy

Welcome to the Maximus Pulse mobile application (the “App”) provided by Maximus Real Estate Partners (“Maximus,” “we,” “us” or “our”). Your privacy is important to us. This privacy policy (“Privacy Policy”) describes the collection of personal information via the App, and how that information is used and shared. By using the App, you acknowledge you have read and understood this Privacy Policy. If you do not agree with the privacy practices described in this Privacy Policy, you may not use the App.

WHAT INFORMATION DO WE COLLECT?

We may collect the following information from and about you when you use the App:

  • Name
  • Email address
  • Phone number
  • Postal address
  • Dwelling unit
  • Pictures, if you choose to attach pictures to maintenance tickets
  • App usage information, including user sign in, feature usage, and frequency of use
  • Payment information, if you pay rent through the App (note that payment information is collected and processed using a third party payment processor)

In some instances, you may provide this information directly in the App.  In other instances, the App will obtain this information based on the data provided during our other business processes, such as the rental application and leasing processes.

HOW DO WE USE THE INFORMATION WE COLLECT?

We use the information we collect from and about you for the following purposes:

  • To provide the App
  • To provide resident services through the App
  • To send you marketing communications
  • To respond to your inquiries
  • To understand how users use the App and improve user experiences
  • For other legitimate business purposes

HOW MIGHT WE SHARE OR DISCLOSE THE INFORMATION WE COLLECT?

We may release, disclose, disseminate, make available, transfer, or otherwise communicate the information described in above to the following categories of third parties in the following circumstances:

  • To third party service providers, agents or independent contractors who help us maintain the App and provide other administrative services to us.
  • We may share your personal information in the course of any reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.
  • We may disclose your personal information to law enforcement, government agencies, and other related third parties, in order to comply with the law, enforce our policies, or protect our or others’ rights, property or safety.

THIRD PARTY SERVICES AND LINKS

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us.

The App may contain links to other sites. In general, we are not responsible for the privacy practices or content of such other sites. Once you leave the App or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy.

COOKIES AND OTHER SIMILAR TECHNOLOGIES

Where necessary, the App uses we may use various technologies to collect and store technical information about the activity on the App, and to store information about a user’s preferences and history in order to better serve the user and/or present the user with customized content. These technologies are used to perform different functions, which we explain below:

  • Essential. These enable you to move around the App and use its features, such as accessing secure areas of the App.
  • Analytics. We may collect information such as your browser, network, and device; IP address; clicks; internal links; pages visited; scrolling; searches; and timestamps. We use this information to learn about traffic and activity.

Generally, you can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie. Please note that if you do not accept cookies, you may not be able to use some features of the App.

SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk.

CHILDREN’S ONLINE PRIVACY

You must be 18 years or older to use the App. We do not knowingly collect personal information from children under the age of 18.

YOUR PRIVACY RIGHTS

If you would like to unsubscribe from our communications at any time, you may do so in the footer of any of our emails. If you would like us to delete your information entirely, or request the personal information we store about you, please contact us using the contact information provided below. Otherwise, by continuing to interact with our emails and App, you provide us with permission to manage and use your data for the purposes set out above.

ASSIGNMENT

In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal information collected via the App.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, and will update the “Last Updated” date above when we do so. Changes and clarifications will take effect immediately upon their posting on the App. If we make material changes, we will notify you more directly that it has been updated, for example by posting a notification or message on the App or by emailing you prior to such changes taking effect.
